1. Acceptance of Terms

By creating an account or using Gifted ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. We reserve the right to update these terms at any time; continued use constitutes acceptance of any changes.

2. Description of Service

Gifted is a wishlist application that allows users to create personal gift wishlists, share them with friends and family, and allow others to claim gifts secretly so surprises are preserved. The Service is provided free of charge.

3. Account Registration

You must sign in using a valid Google or Instagram account to use Gifted. You are responsible for maintaining the security of your account and all activity that occurs under it. You must be at least 13 years old to use the Service. By signing in with Instagram or Google, you authorize us to access basic profile information as described in our Privacy Policy.

4. User Content

You retain ownership of the content you create on Gifted, including wishlist items, descriptions, and links. By posting content, you grant us a limited license to display and store that content solely for the purpose of providing the Service.

You agree not to post content that is illegal, harmful, harassing, or infringes on the rights of others. We reserve the right to remove content that violates these terms.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose • Attempt to access other users' accounts or private wishlists without authorization • Scrape, crawl, or systematically extract data from the Service • Interfere with or disrupt the integrity or performance of the Service • Use the Service to send spam or unsolicited communications

6. Third-Party Links and Products

Wishlist items may contain links to third-party websites. We are not responsible for the content, availability, or privacy practices of those sites. Adding a product link to your wishlist does not imply endorsement by Gifted.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that gifts listed will be available for purchase.

8. Limitation of Liability

To the maximum extent permitted by law, Gifted and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time by contacting us at giftedappinsta@gmail.com. Upon termination, your wishlist data will be deleted within 30 days.

10. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Colorado.
